1. Service Description

FoodCop is a mobile application that uses artificial intelligence to analyze photographs of food, provide estimated calorie counts, deliver entertaining commentary, and suggest personalized exercise plans. The app is available on iOS and Android platforms.

2. Acceptance of Terms

By downloading, installing, or using FoodCop, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

3. User Responsibilities

  • You must be at least 13 years of age to use FoodCop.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to use the app only for its intended purpose of food scanning and fitness planning.
  • You agree not to misuse the service, reverse-engineer the app, or attempt to access other users' data.

4. Subscription Terms

FoodCop offers a free tier with limited functionality (3 lifetime scans) and premium subscription plans:

  • Monthly Plan: $9.99 per month
  • Annual Plan: $49.99 per year
  • Both plans include a 7-day free trial for new subscribers.
  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

5. Cancellation Policy

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. After cancellation, you will retain access to premium features until the end of your current billing cycle.

6. AI Accuracy Disclaimer

FoodCop uses artificial intelligence (GPT-4o Vision) to estimate calorie content from food photographs. These estimates are approximations only and should not be relied upon as precise nutritional data. FoodCop is not a medical device and does not provide medical, dietary, or nutritional advice. Always consult a qualified healthcare professional or registered dietitian for specific dietary guidance.

7. Exercise Plans Disclaimer

Exercise suggestions provided by FoodCop are based on general MET (Metabolic Equivalent of Task) calculations and are intended as general fitness guidance only. They are not personalized medical advice. Consult your physician before starting any exercise program, particularly if you have pre-existing health conditions.

8. Intellectual Property

All content, features, and functionality of the FoodCop app, including but not limited to text, graphics, logos, icons, images, audio clips, comedy content, and software, are the exclusive property of FoodCop and are protected by international copyright, trademark, and other intellectual property laws.

9. User-Generated Content

Food photos you submit are processed by our AI service for analysis. You retain ownership of your photos. By using the app, you grant FoodCop a limited license to process your images solely for the purpose of providing the food analysis service. Photos are not stored permanently on our servers after analysis is complete.

10. Limitation of Liability

To the maximum extent permitted by applicable law, FoodCop and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these terms. You may delete your account at any time through the app's profile settings, which will permanently remove all your data from our servers.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new terms within the app. Your continued use of FoodCop after changes are posted constitutes your acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
